The consulting services ("the Services") include carrying out a comparative analysis ofKazakhstan's legislation and leading international practices of standards andregulations in the area of intellectual property and the commercialization ofscientific and technical activity in order to develop practical recommendationsto improve the legislation of the Republic of Kazakhstan. The expectedduration of the Assignment is 4 months from the contract signing date. The Ministry ofEducation and Science of the Republic of Kazakhstan is seeking 4 IndividualConsultants to perform the services as a group in collaboration with eachother. The group of Individual Consultants will consist of: Individual Consultant on North America countries; Individual Consultant on Europe countries; Individual Consultant on EAEU countries (RussianFederation and Republic of Belarus) and Individual Consultant on Kazakhstan National Legislation. QUALIFICATION REQUIREMENTS AND BASIS FOR EVALUATION(EVALUATION CRITERIA) The Consultant shall have experience in conducting research andpreparing expert findings in the sphere of intellectual property and commercializationof results of scientific and technical activity (not less than 5 expertfindings and research projects over the last 5 years); The Consultant shall also have experience of analysis of the legislationof North America countries in the sphere of intellectual property (not lessthan 2 works over the last 3 years); The Consultant must have a scientific of PhD or Candidate of Sciencedegree (or equivalent); The working experience in the sphere of intellectual property andcommercialization of results of scientific and technical activity should be notless than 5 years; If the Consultant has publications in the field of commercialization of resultsof scientific and technical activities and intellectual property, as well aswith respect to the legislative aspects of intellectual property management,including monographs, publications in scientific journals the list ofsuchpublications shall be attached. SCOPE AND THE CONTENT OF SERVICES To read/review the current legislation of the Republic of Kazakhstan,conditions of innovative development of the Republic of Kazakhstan, currentstate and areas for improving innovative activities in order to identifyproblematic issues in the field of registration of rights, protectionandcommercialization of the intellectual creative activity results, including analysis of the laws,legal acts and other documents of the Republic of Kazakhstan . To analyze the legislation of North America countries (not lessthan 2countries) in the sphere of intellectual property and innovation activity(including institutional support); the main tendencies of patent and licensedevelopment, particular issues of fixing, distribution and transfer ofintellectual property rights should be taken into account. Analysis of the legislation of the Republic ofKazakhstan and North America countries should be conducted taking into accountthe levels of relationships associated with registration, securing,distribution and transfer of rights to the intellectual creative activityresults between the entities ; Analysis of concepts and definitions ; To analyze incentive mechanisms, including but notlimited to, tax, tariff, and state-financed stimulation of inventive activity;innovation activity of higher education institutions and scientific institutes;enterpr
